Emerging Constitutional Rights

Research Project

For this research project, you will pick a constitutional issue related to a specific area of constitutional law that you think will be brought before the Supreme Court in the next two years. The constitutional issue should focus on an emerging topic or area of concern involving constitutional rights. Your issue may relate to any area of constitutional law, such as freedom of speech, freedom of religion, cruel and unusual punishment, etc. Once you have selected your constitutional issue,

1. Describe your constitutional issue in detail. What historical events and societal issues make your chosen issue an emerging topic or area of concern involving constitutional rights?
2. Describe the area of constitutional law related to your chosen issue. What major cases helped to shape the Supreme Court’s interpretation of the issue as it currently stands?
3. How do you think the Supreme Court should rule on your chosen issue? In other words, should they rule in favor or against the position you are advocating for?
4. If the Supreme Court rules as you indicate in #3 above, describe the potential effects on the administration of justice (i.e. legal rights for applicable individuals). What will be the effects on society at large? Will some groups be more affected by the decision than others? How?
5. What arguments, based on #4 above, would opponents of your position potentially raise in response to the Supreme Court’s decision on your issue? How would you attempt to refute those arguments?

Your paper must include at least 10 outside sources (not your textbook) cited in proper APA format. At least 3 of your cited sources muse be prior Supreme Court decisions. Minimum required length for final paper is 6 double-spaced pages.
